Reddit Challenges Australia’s Social Media Ban for Children in High Court

Reddit has launched a legal challenge in Australia’s High Court seeking to overturn the country’s recently introduced ban on children under 16 accessing social media, arguing that the law infringes on free political communication. The move marks a major escalation in opposition to the world-first measure, which came into effect on 10 December.

The San Francisco-based platform, which counts Australia among its largest markets, filed documents naming the Commonwealth of Australia and Communications Minister Anika Wells as defendants. Reddit’s filing contends that the ban is unconstitutional because it restricts the political discourse of young Australians, a right implied under the nation’s constitution. The company also argued that even if the law were upheld, it should be exempted since it does not meet the legal definition of a social media service.

Reddit’s lawsuit follows an earlier challenge by two teenagers affiliated with a libertarian group, who filed suit last month against the same legislation. As a major technology company with a market valuation of $44 billion, Reddit brings significant resources to the fight, raising the prospect of a protracted legal battle. Legal analysts note that a victory for Reddit could set a precedent for other platforms to contest the law.

The Australian government has defended the measure as a necessary safeguard for children. Communications Minister Anika Wells said the administration would “stand firm to protect young Australians from experiencing harm on social media” and emphasized that the law is intended to support parents and children, not corporations. Health Minister Mark Butler described Reddit’s lawsuit as motivated by profit rather than concern for children’s rights, likening it to tactics historically used by Big Tobacco against public health regulations.

Under the law, platforms must block users under the age of 16 or face fines of up to A$49.5 million (€28 million). Underage users and their guardians are not penalized. Platforms have adopted measures such as age inference based on online activity or age estimation through photos to comply with the legislation.

In its court filing, Reddit raised concerns about privacy and political expression, highlighting that barring under-16s could impede future voters from engaging with political information prior to turning 18. The filing argued that exposure to online discussion shapes the perspectives of young Australians as they approach voting age.

The law affects major platforms including Instagram, YouTube, TikTok, and Reddit, all of which opposed the legislation before agreeing to comply temporarily. Reddit’s challenge intensifies scrutiny over the implications of the law, which has drawn debate over children’s online safety, free expression, and corporate accountability.

As the case proceeds, Australia’s High Court could be asked to weigh the balance between protecting minors and safeguarding constitutional rights to free political communication, potentially shaping the future of social media regulation in the country and beyond.
